1. Authorization and Legal Responsibility: The individual signing this agreement (whether the legal owner or an authorized representative) warrants that they have the full legal right and authority to authorize the transport and cremation of the deceased pet. You agree to indemnify and hold harmless Compassionate Pet Transport, Inc. from any and all liability, claims, or damages arising from a dispute of ownership or lack of proper authorization. You confirm that you are legally responsible for this decision and for all associated charges.
2. Identification & Handling of Remains: We use reasonable measures to ensure that your pet’s remains are tracked and identified throughout the process. In private cremation, your pet will be cremated individually, and the ashes returned are intended to be exclusively those of your pet. In communal cremation, pets are cremated together, and individual ashes cannot be separated or returned. While we utilize industry-standard tracking, minor, unavoidable incidental commingling of cremated material may occur due to processing limitations.
3. Private Cremation Disclaimer: Private cremation is performed with the intent of returning only your pet’s ashes to you. However, due to the physical nature of the cremation process and equipment, Compassionate Pet Transport, Inc. cannot guarantee the complete absence of incidental residual material from previous cremations.
4. Communal Cremation Disclaimer: In communal cremation, multiple pets are cremated at the same time without physical separation. As such, no ashes can be individually identified or returned. You acknowledge that this option is a group cremation process and that all cremated remains are collectively disposed of in a lawful and respectful manner in accordance with state and local regulations.
5. Transport-Related Disclaimer: We handle the transportation of deceased pets with dignity and care. You understand that transportation times may vary and may be delayed due to weather, traffic, or other unforeseen events. Compassionate Pet Transport, Inc. is not responsible for incidental deterioration of remains during transit that results from natural decomposition or conditions beyond our control.
6. Third-Party Facilities Disclaimer: Our services may involve third-party crematories and veterinary facilities. While we strive to work only with reputable partners, we do not directly control their operations and shall not be held liable for their acts, omissions, errors, or policies.
7. Disclaimer of Crematory Operations: Compassionate Pet Transport, Inc. is not a crematory. We are registered as a Deceased Pet Transport Corporation. All cremations are handled by one of our trusted and certified crematory partners.
8. Client Acknowledgment: By signing below, I confirm and agree to the following: Ownership/Authority – I am the pet’s legal owner or have legal authorization to arrange aftercare. Process Understanding – I understand the difference between private and communal cremation and have chosen my preferred option above. Identification Measures – Reasonable efforts will be made to tag, track, and identify my pet throughout the process, but absolute guarantee of separation is not possible. Transportation Risks – I acknowledge that Compassionate Pet Transport, Inc. will handle transport with dignity, but delays or condition changes may occur due to weather, traffic, decomposition, or other conditions beyond their control. Third-Party Facilities – Some or all cremation work may be performed by trusted third-party crematories. The company is not liable for acts or omissions of those providers. Liability Release – I release Compassionate Pet Transport, Inc., its staff, and contractors from any liability, claim, or loss arising from the cremation process, except in cases of proven gross negligence or willful misconduct. Regulatory Compliance – Procedures may be adjusted to comply with applicable local, state, and federal laws, which may affect timelines or processes.
9. General Liability Disclaimer: By engaging in services with Compassionate Pet Transport, Inc., you acknowledge and agree that while we exercise the utmost care and respect in handling your pet, our company shall not be held liable for any circumstances beyond our direct control, including but not to delays due to weather, transportation incidents, misidentification caused by third-party facilities, or mechanical failures.
10. Payment Disclaimer and No Refund Policy: By providing your credit card information, you, as the owner of the deceased pet and the cardholder, agree to the following terms:
Cardholder Verification: You attest that you are the authorized user of the credit card provided for payment and that the billing information is current and accurate.
Authorization of Charges: You authorize Compassionate Pet Transport, Inc. to charge your credit card for the full amount of the selected services at the time of engagement.
All Sales Final and No Refunds: You understand and agree that all payments are final and non-refundable, regardless of any subsequent change of mind or circumstances. Once services are engaged and payment is processed, the service is considered rendered. This no-refund policy is absolute and without exception.
Dispute Resolution: Should you have any concerns regarding the services provided, you are encouraged to contact Compassionate Pet Transport, Inc. directly to seek a resolution. By agreeing to these terms, you waive the right to initiate a chargeback with your credit card company for services rendered. Any attempt to initiate a chargeback will be disputed, and this agreement will be provided as evidence of your consent to the no-refund policy.
10A. 3-Week Simple Payment Plan — Terms & Authorization (If Selected): If I select the “3-Week Simple Payment Plan,” I understand and agree that this is a payment arrangement (not a discount) offered by Compassionate Pet Transport, Inc. (“Company”) for eligible services only. By selecting this option, I authorize the Company to charge or invoice me according to the payment schedule shown on this agreement (the “Plan”).
Plan Schedule & Due Dates: The Plan consists of (1) an initial deposit due upon arrival/service engagement, followed by (2) two additional weekly payments. I understand that failure to make any scheduled payment by its due date constitutes a default under this agreement.
Hold on Ashes / Return of Remains: I acknowledge and agree that, if the Plan is selected, the Company (and/or its crematory partners) may securely hold my pet’s cremated remains and/or related keepsakes until the Plan balance is paid in full. I understand that final release/return of ashes is contingent upon full payment being received and successfully processed.
Legal Responsibility for Payment: I agree that I am legally responsible for the full balance owed for services rendered, including any remaining amount due under the Plan. I understand that services may be performed and completed prior to final payment, and I remain liable for the total charges regardless of return timing.
Late / Failed Payments & Collections: If any payment is missed, declined, reversed, disputed, or otherwise not received, I authorize the Company to contact me by phone, text, email, and/or mail regarding the overdue balance. If the balance remains unpaid after reasonable attempts to resolve it, I understand the Company may pursue lawful collection efforts, which may include referral to a third-party collection agency and/or legal action as permitted by applicable law. I agree that I am responsible for any costs of collection to the extent allowed by law.
No Chargebacks / Disputes for Services Rendered: I agree not to initiate chargebacks or payment disputes for services that have been rendered. If I have a concern, I will contact the Company directly to seek resolution. I understand that payment disputes may delay return of ashes and may be treated as non-payment under the Plan.
Acknowledgment: By selecting the 3-Week Simple Payment Plan and signing this agreement, I confirm I understand these terms and agree to pay the full Plan amount as scheduled.
11. Confidentiality: Compassionate Pet Transport, Inc. is committed to protecting your privacy. All personal information provided by you will be kept strictly confidential and will not be disclosed to any third party, except as required to perform the agreed-upon services or as required by law.
12. Compliance & Regulatory Disclaimer: Compassionate Pet Transport, Inc. operates in accordance with applicable state, county, and municipal laws regarding animal remains transportation, cremation, and disposal. You acknowledge that legal requirements vary by jurisdiction and that our company must comply with all relevant regulations, which may affect timelines, procedures, and the return of remains.
13. Force Majeure: Compassionate Pet Transport, Inc. shall not be held liable for any failure of or delay in the performance of this agreement for the period that such failure or delay is due to a cause beyond its reasonable control, including but not to delays due to acts of God, war, government orders, pandemics, natural disasters, or other force majeure events.
14. Arbitration: Any dispute or claim arising out of or relating to this agreement shall be settled by binding arbitration administered by a neutral arbitrator in accordance with the laws of the State of California. The arbitration shall take place in Los Angeles County. By signing this agreement, you waive your right to a jury trial for any disputes arising from these services.
15. General Legal Disclaimers:
Limitation of Liability: Compassionate Pet Transport, Inc.'s liability for any and all claims, damages, or losses, whether direct or indirect, shall be limited to the total amount paid for the services. In no event shall Compassionate Pet Transport, Inc. be liable for any emotional distress, consequential, or incidental damages.
Indemnification: The cardholder agrees to indemnify and hold harmless Compassionate Pet Transport, Inc., its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with the services provided, including any claims related to the ownership of the pet or the authorization for cremation.
Governing Law: This agreement shall be governed by and construed in accordance with the laws of the state in which Compassionate Pet Transport, Inc. operates.
By engaging the services of Compassionate Pet Transport, Inc., and providing payment as the owner of the deceased pet and the cardholder, you acknowledge that you have read, understood, and agree to be bound by these legal statements and the no-refund payment disclaimer.
